The petitioner apprehends his arrest in Complaint Case No. 70(C)/2016, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code. The complainant alleged that the petitioner along with Bhagirath Prasad, Pawan Kumar and Vijay Mahto came and persuaded him to give money to provide him job in C.I.S.F. The complainant alleged that he deposited money in the account of Ashok Anand, Anand Kumar Sinha and Arvind Kumar and also got appointment letter, but the appointment letter was found forged.

Patna High Court Cr.Misc. No.26074 of 2017 (2) dt.13-07-2017 2/2 Learned counsel for the petitioner submits that the petitioner is, of course, named in the complaint petition, but no specific allegation is made against the petitioner. The petitioner did not receive any amount from the complainant or any other person. Money was deposited in the account of Ashok Anand, Anand Kumar Sinha and Arvind Kumar. Further, Bhagirath Prasad @ Kumar Vishwajeet Sinha has already been enlarged on anticipatory bail vide order dated 02.02.2017 passed in Cr. Misc. No. 374/2017. Case of the petitioner stands on the same footing.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Complaint Case No. 70(C)/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
