2. In this case, the petitioner is seeking regular bail in connection with Naugachiya P.S. Case No. 385 of 2024, registered for the offences punishable under Sections 20(b)(ii) (B), 8 and 29 of NDPS Act, 1985.

3. As per allegation, the petitioner is alleged to be the driver of the truck wherefrom 8.8 kg of ganja was recovered.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. The quantity of alleged contraband is less than the

Patna High Court CR. MISC. No.24075 of 2025(5) dt.06-08-2025 2/2 commercial quantity. The petitioner is under custody since 16.11.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Presently, I am not inclined to grant bail to the petitioner. Accordingly, it is rejected.

7. However, the petitioner, if so advised, may renew his prayer for bail, after remaining under custody for one year. (Nawneet Kumar Pandey, J) kundan/- U T
