2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 189(2), 126(2), 115, 352, 109 and 85 of the BNS and under Sections 3 and 4 of the Dowry Prohibition Act.

3. The case of the prosecution, in short, is that the informant was married with one Arun Kumar and they were having a daughter out of the wedlock. The allegation is that the informant was subjected to cruelty on account of non-fulfillment of dowry demand of Rupees Two Lakh. On 03.08.2024, the petitioner along with other in-laws on pretext of watching fair organized in Barabar Mountain, took her to a secluded place in

Patna High Court CR. MISC. No.23375 of 2026(2) dt.17-04-2026 2/2 forest and assaulted her with slaps, fists and bricks and thinking her to be dead, the assailants fled away.

4. Learned counsel for the petitioner submits that the allegation against the petitioner is general and omnibus. Learned counsel has further submitted that the petitioner is brother-in-law of the informant and is in custody since 23.09.2025. Learned counsel for the petitioner has further submitted that even the husband and other similarly situated co-accused have been granted bail by the learned Co-ordinate Benches of this court vide Cr. Misc. Nos. 52672 of 2025 and 4558 of 2025. The case of this petitioner stands on similar footing.

5. Learned Additional Prosecutor for the State has vehemently opposed the bail application of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Khizersarai P.S. Case No. 279 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-XIX, Gaya Jee.
