The petitioner apprehends his arrest in connection with Belaganj P.S. Case No. 127 of 2015 registered for the offences punishable under Sections 341, 447 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that he fired but no fire arm injury was found on the person of the informant. It is further submitted that there are some differences between the petitioner and the informant with regard to passage of drain water in the Nali, situated next to their houses, which led to the present occurrence.
Considering the aforesaid submissions and also the fact that petitioner has no criminal antecedent, let the petitioner above
Patna High Court Cr.Misc. No.48349 of 2015 (2) dt.08-01-2016 named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Belaganj P.S. Case No. 127 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
