As per order dated 23.03.2022 the prayer for grant of anticipatory bail on behalf of petitioner no. 2 above named has dismissed as withdrawn and is now restricted to petitioner on. 1 above named only.
The petitioner no. 1 apprehends his arrest in
Patna High Court CR. MISC. No.32570 of 2021(5) dt.16-05-2022 2/3 connection with Mahnar P.S. Case No.06 of 2021 registered for the offences punishable under Sections 447, 341, 323, 324, 325, 307, 380, 504/34 of the Indian Penal Code.
The supplementary affidavit has been submitted by the petitioner no.1 in which he has explained that he has only one antecedent in one case, the second case has been already finalized by Lok Adalat and, therefore, that shall not be treated as antecedent and in the third case, the petitioner no. 1 is not involved but one person having same name is involved. The petitioner no. 2 has already been arrested. The petitioner no. 1 is said to have assaulted the victim but no injury has been caused on the vital part of the organ. Considering the nature of dispute, this application for anticipatory bail is allowed.
Accordingly, let the petitioner no. 1 above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 06 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
