The petitioner apprehends his arrest in Bahadurpur (Fekla O.P.) P.S. Case No. 434 of 2013, corresponding to T.R. No. 2667 of 2017 registered for the offences punishable under Sections 414 and 34 of the Indian Penal Code and under Section 7 of the Essential Commodities Act.
The petitioner is alleged to have purchased 20 bags of wheat from the PDS shop dealer Devendra Yadav. Learned counsel for the petitioner submits that Devendra Yadav has already been enlarged on anticipatory bail. No shortage of foodgrains was found in the shop of Devendra Yadav.
Considering the facts aforesaid the petitioner above
Patna High Court Cr.Misc. No.26017 of 2017 (2) dt.07-07-2017 2/2 named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned Sub-Divisional Judicial Magistrate, Darbhanga in Bahadurpur (Fekla O.P.) P.S. Case No. 434 of 2013, corresponding to T.R. No. 2667 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
