JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 05-10-2015 The petitioner prays for restoration of electric connection which had been disconnected on 26.2.2009 alleging that in raid on 25.2.2009 he was found using load of 5 KW, though he had been allowed 1 KW load. Nokha Police station Case No. 35 of 2009 under section 379 Indian Penal Code read with sections 135, 136, 39 and 40 of the Electricity Act was also lodged against him. A provisional bill of Rs.1,50,000/- was also issued to the petitioner.

The petitioner submits that he has also filed an objection before the Assessing officer under section 126 of the Electricity Act. He submits that he cannot be asked to pay the bill after 25.2.2009, as the energy connection has already been disconnected.

The writ petition is disposed of with direction to the Assessing officer to dispose of petitioner's objection after
