The petitioners, namely, three in number, apprehend their arrest in a case under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code and Section 3(1)(X) of the SC/ST Act. The informant alleged that while he was passing through a lane, the petitioners caught him and fell him down from the motorcycle. It is alleged that the petitioners also assaulted and abused the informant by naming his caste. It is submitted that Rahul Raj @ Rahul Kumar @ Rahul Yadav (petitioner no. 2) lodged Kotwali P.S. Case No. 315/2015 on the same day and alleged that it is the informant Arvind Kumar Chaudhary, who was driving the motorcycle in inebriated condition and dashed him on
Patna High Court Cr.Misc. No.40940 of 2015 (2) dt.06-10-2015 2/2 account of which some altercations took place. It appears that there is a case and counter-case.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Gaya in SC/ST Gaya P.S. Case No. 33/2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
