JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 364, 379, 120B of the Indian Penal Code. The prosecution case is that due to the dispute of two rivalry groups of two villages the informant was being dragged by the mob. In the meantime the police reached at the spot and sat the informant free.
It is submitted by learned counsel for the petitioners that on mere suspicion the accusation has been levelled against the petitioners. The petitioners were not caught on the on the spot and the persons who were caught on the spot were granted bail by learned Court below on the basis of compromise.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.40045 of 2015 (2) dt.06-10-2015 2/2 petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Kishanganj in connection with Terhagachh P.S. Case No. 94 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
