The petitioner apprehends his arrest in connection with Gopalpur P.S. Case no. 11 of 2016, registered under Sections 363 and 366(A) of the Indian Penal Code.
The accusation is that on 08.02.2016, in the evening, daughter of the informant enticed away by Raj Kishore Bhagat, son of Gopal Bhagat, Dhanraj Bhagat, son of Gopal Bhagat, Gopal Bhagat and Daroga Manjhi (Petitioner).
Learned counsel for the petitioner submits that, in fact, due to love affair, daughter of the informant left her parental house with Raj Kishore Bhagat, son of Gopal Bhagat and they performed marriage on 27.01.2016 and both also obtained Marriage Certificate to the office of Registrar, Hindu Marriage/Sub-Registrar-II, Sadar, Gorakhpur, but petitioner being the neighbour of the informant and
Patna High Court Cr.Misc. No.26205 of 2017 (6) dt.09-11-2017 2/2 due to land dispute has falsely been implicated in this case. The wife of the informant has also stated in her statement in para 5 of the case diary that she had seen her daughter moving with Raj Kishore Bhagat. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-XI, Gopalganj in connection with Gopalpur P.S. Case No. 11 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
