The petitioner seeks bail in a case registered under Sections 356, 379 of the Indian Penal Code.

The prosecution case, in short, is that two unknown persons opened the dicky of the informant and snatched away the bag kept in the dicky of the motorcycle.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 15-01-2019. Charge sheet in this case has already been submitted. The petitioner is not named in the FIR. The name of the petitioner has surfaced in this case on the basis of self-confessional statement of the petitioner before the police. There is no

Patna High Court CR. MISC. No.24460 of 2019(3) dt.14-05-2019 2/2 recovery of any incriminating article from possession of the petitioner. It has further been submitted that the petitioner may be released after completion of seven months in custody. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of seven months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar, Motihari in connection with Rajepur P.S. Case No. 94 of 2018.
