JUSTICE ANIL KUMAR SINHA ORAL ORDER 01-12-2020 Heard Mr. Hari Kishore Thakur, learned counsel for the petitioner and Mr. Akshay Lal Pandit, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Kudhani P.S. Case No. 259 of 2020 registered for the offences punishable under Sections 4/8 of POCSO Act. The allegation as per the First Information Report is that the petitioner allegedly entered into the house of the informant and tried to outrage the modesty of his daughter. The victim is said to be a minor girl, aged about 12 years. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner

No.24153 of 2020(4) dt.01-12-2020 2/3 alleged and he has falsely been implicated in this case due to village politics inasmuch as the petitioner is co-villager of the informant. Learned counsel further submits that the statement of victim girl has been recorded under Section 164 Cr. P.C., in which, she has not stated anything against the petitioner except that he had allegedly entered into the room of the victim and had caught hold her hand. Learned counsel also submits that the petitioner has got no criminal antecedent and he is in custody since 10.05.2020. Having heard learned counsel for the parties and taking into consideration the materials on record and the statement of victim girl recorded under Section 164 Cr. P.C., I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge cum Special Judge, Muzaffarpur, in connection with Kudhani P.S. Case No. 259 of 2020.
