The petitioner seeks bail in Raniganj P.S. Case No. 105/2018, instituted for offences under Section(s) 302, 201 and 34 of the Indian Penal Code.
It is alleged in the written report that on the date of occurrence son of informant had gone alone by his motorcycle. At about 8:30 P.M. informant made contact with him on his mobile then he told that he is at Barhara and he will come soon. In the next morning husband of Surpanch of the village, namely, Krishna Nand Chaudhary informed the informant that somebody after killing his son has thrown the dead body near culvert. Thereafter informant went at that place and found the dead body of his son. There was injuries on the forehead and back side of deceased.
Patna High Court Cr.Misc. No.76484 of 2018(2) dt.21-01-2019 2/2 Learned counsel for the petitioner has submitted that petitioner is not named in the written report. Name of this petitioner has come during investigation in the confessional statement of co-accused Prince Kumar and Pawan Kumar. There is no eye-witness to the occurrence.
The other co-accused persons have already been granted bail by different Benches of this Court vide order dated 13.09.2018 passed in Cr. Misc. No. 38300/2018 and order dated 05.10.2018 passed in Cr. Misc. No. 52562/2018. Petitioner is in custody since 29.04.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in connection with Raniganj P.S. Case No. 105/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
