In the present case, the petitioner is seeking bail in Runnisaidpur P.S. Case No.246 of 2019 registered for offences punishable under Sections 384, 385, 307 of the Indian Penal Code and Section 27 of the Arms Act. The allegation has been made in the FIR that when the informant was at his shop, the co-accused Sarvesh Das and other two miscreants came at Apache Motorcycle and started indiscriminate firing, for demand of extortion money, upon the informant causing injury in his left hand. However, counsel for the petitioner submits that earlier the petitioner filed a Cr. Misc. No. 79144 of 2019 for
Patna High Court CR. MISC. No.33155 of 2020(3) dt.22-12-2020 2/3 grant of bail, which was rejected by this Court vide order dated 11.12.2019 with a liberty to renew his prayer after one year of his custody and now the petitioner has remained in judicial custody for one year and six months as he is in judicial custody since 25.06.2019.
Considering the period of custody, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 246 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds with further condition that one of the bailor will be the close relative of the petitioner.
That apart, in view of the antecedents of the petitioner, he would be required to appear before the Officerin-charge of the concerned police station within fifteen days of his release with a copy of this order and every month thereafter for the next six months. The conduct of the petitioner will be kept under watch in the aforesaid period by
Patna High Court CR. MISC. No.33155 of 2020(3) dt.22-12-2020 3/3 the police station concerned and if it is found wanting in any respect, a report shall be made to the court concerned by him to initiate a proceeding for cancellation of bail for reasons of misuse of bail.
