JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-03-2023 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioners are languishing in custody in a case registered for the offences punishable under Sections 366 & 34 of the Indian Penal Code.

It is alleged by the informant that his wife has fled away along with the accused persons including the petitioners by keeping jewelery and cash of Rs. 30,000. It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. The victim had love

Patna High Court CR. MISC. No.24822 of 2022(3) dt.20-03-2023 2/2 affairs with co-accused Vikko Kumar and the victim in her 164 Cr.P.C. statement has specifically alleged against co-accused Vikko Kumar that he has committed wrong with her. The petitioners have been roped in the present case since they happen to be the brother of coaccused Vikko Kumar. The petitioners are languishing in custody since 02.12.2022. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 670 of 2021.
