JUSTICE SHIVAJI PANDEY ORAL ORDER 17-08-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Forbesganj P.S. Case No.558 of 2016, registered for the offence punishable under Sections 147, 148, 149, 323, 313, 328, 304B, 504, 386, 506 and 201 of the Indian Penal Code.

The marriage of the daughter of the complainant was solemnized with Rajesh Mandal two years earlier. Allegation has been made that after the marriage the accused persons started demanding dowry. It appears from paragraph no.5 of the case diary that incident took place in Punjab, whereas the petitioner at the time of incident was in Forbesganj. The

Patna High Court Cr.Misc. No.26556 of 2017 (3) dt.17-08-2017 2/2 petitioner is aged about 70 years. Further, from the F.I.R. it appears that the poison was administered by Rajesh Mandal and Nitu Devi.

Looking to the aforesaid facts, let the petitionerSuresh Mandal be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No.558 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) pawan/- U T
