Petitioners apprehend their arrest in Uchkagaon P.S. Case No.196 of 2018, registered under Sections 366A and 34 of the Indian Penal Code.

The informant alleged that the petitioners and others kidnapped his minor daughter.

Learned counsel for the petitioners submits that the informant is not an eye witness of the occurrence. The victim appeared and made her statement under Section 164 Cr.P.C. She disclosed that she aksed Biran Manjhi to take her along with him and on such Biran Manjhi took her to Lucknow. She further

It is submitted that Biran Manjhi has already been granted regular bail. Petitioners are father and brothers of Biran Manjhi. The victim did not name the petitioners in her statement recorded under Section 164 Cr.P.C. Having considered the facts aforesaid and the fact that the victim did not name the petitioners in her statement recorded under Section 164 Cr.P.C. and the victim denied the factum of her kidnapping, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., IX, Gopalganj in connection with Uchkagaon P.S. Case No.196 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
