JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-03-2018 Pursuant to the order dated 06.12.2017, the parties have decided to close the instant case by settling the matter amongst them.

The learned counsel for the petitioners as well as the learned counsel for the opposite party no. 2 jointly submit that with the intervention of the well-wishers, the entire dispute amongst them have been settled in an amicable manner and it has been decided that the petitioners herein would pay a sum of Rs. 1 lac to the opposite party no. 2 in full and final settlement, pursuant whereof, the order taking cognizance shall be quashed

Patna High Court Cr.Misc. No.45651 of 2014 (5) dt.07-03-2018 2/2 with the consent of the parties.

In view of the aforesaid, the learned counsel for the petitioners has produced a draft for a sum of Rs. 1 lac in favour of the opposite party no. 2 which is handed over to the learned counsel for the opposite party no. 2.

Since the matter has been settled and a sum of Rs. 1 lac stands paid by way of the aforesaid draft, there is no need to prolong the instant case any further. In such view of the matter, with the consent of the parties, the order dated 04.01.2014 passed by Sri Ghanshyam Singh, Judicial Magistrate 1st class, Patna in complaint case no. 3961(c) of 2013 is hereby quashed. The petition is disposed of.
