The petitioners, four in number, apprehend their arrest in a case under Sections 307, 332, 338, 379 and other sections of the Indian Penal Code.
The Circle Officer, Madhepura named the petitioners and alleged that the petitioners and other accused persons made protests against encroachment drive and removal of the encroachment from Vijay Ashram. Members of the mob set ablaze a JCB machine. They also pelted stones causing injury to the police and administrative officials. It is submitted that of course the petitioners are named in the F.I.R. but no specific allegation is
Patna High Court Cr.Misc. No.40951 of 2015 (2) dt.06-10-2015 2/2 made against the petitioners. Similarly situated 11 persons, namely, Mahesh Mahto, Ganesh Mahto and others have already been granted anticipatory bail vide order passed in Cr. Misc. No. 38929/2015.
Considering the facts aforesaid and the fact that the case of the petitioners is similar to that of Mahesh Mahto and others, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Jhanjharpur in Madhepura P.S. Case No. 28/2015 (G.R. No. 566/2015) subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
