The petitioner seeks bail in a case instituted for the offences under Sections 356, 379 and 411 of the Indian Penal Code.

The prosecution case in short is that the accused person snatched the bag of the informant containing cash amount.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.2.2019 and has no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner has been made accused due to mistake of fact. There is no substantive evidence

Patna High Court CR. MISC. No.21909 of 2019(2) dt.12-04-2019 2/2 to suggest his implication in the present case. It is further submitted that the petitioner may be released after completion of six months in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R..

Considering the aforesaid facts and circumstances, on completion of six months in custody, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 117/2019.
