JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 The order dated 30.10.2015 is modified to the extent that last sentence of paragraph No. 2 "Section 4 of the Dowry Prohibition Act" be offloaded .

None appears for the petitioner, however counsel for the O.P. No. 2 is in appearance.

It appears from the report of the Mediator dated 08.12.2015 that petitioner failed to appear before the mediation centre also.

The petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 376, 313, 498A, 406/34 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

The prosecution case is that petitioner initially ravished the informant but subsequently he performed

Subsequently, due to assault the pregnancy of the informant got terminated and thereafter torture was inflicted for non-fulfilment of dowry demand. Considering the nature of accusation and the conduct of the petitioner, let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with K. Nagar (Champa Nagar) P.S. Case No. 150 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Purnea. Accordingly the application is disposed of.
