2. The petitioner seeks bail in connection with Tarapur P.S. Case No. 95 of 2024 dated 12.05.2024, instituted for the offence punishable under Sections 302 and 34 of the Indian Penal Code.
3. The prosecution case, in short, is that, on 09.05.2024 at about 09:30 pm after taking meal the daughter-inlaw of informant went in her room along with her son, Rajvir. On 10.05.2024 at 05:00 am when informant woke up and called his grandson. When he did not heard the sound of his daughter in-law then, he went in room and saw that his grandson was sleeping alone. It is further alleged that door of the room was
Patna High Court CR. MISC. No.22722 of 2025(4) dt.23-07-2025 2/3 opened and door of courtyard was also opened. Then he started searching and found sleeper of Rina Devi near Lasora Gad. It is further alleged that daughter-in-law of informant was lying dead and blood was oozing out from her nose near Lasora tree. Thereafter, her body was sent for post-mortem by the police.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that petitioner is not named in the FIR only on the basis of suspicion, petitioner has been made accused in this case. It is next submitted that the occurrence took place on 10.05.2024 and inquest report was prepared by the police on 10.05.2024 at 06:40 am but the FIR was lodged by informant on 12.05.2024. It is further stated that there is no eye witness to the alleged occurrence. Even the son of the deceased has not said that petitioner came to the house of informant at the night of incident. Further submission is that, police has not collected the CDR of the mobile number of the deceased to connect the version of the son of the deceased. Lastly, it has been submitted that the petitioner is in custody since 20.11.2024 having no criminal antecedents and charge-sheet has been submitted in the case.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Munger in Tarapur P.S.
