JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 1122(C) of 2018 in which cognizance has been taken under Section 498A IPC and Section 4 of Dowry Prohibition Act.

Petitioners happen to be mother-in-law and father-in-law of the complainant and allegation is that they tortured her with respect to demand.

In this case notice was issued to opposite party No.2 by ordinary process as well as registered post but the same has been returned with report that opposite party No.2 is not residing at the given address.

No.26966 of 2019(4) dt.21-08-2019 2/2 Submission of learned counsel for the petitioners is that anticipatory bail application of son of the petitioners has been filed and the matter has been referred to the Mediation Committee in which opposite party No.2 has already appeared. Further submission is that no specific allegation has been attributed against the petitioners and they are ready to abide by the outcome of the mediation between son of the petitioners and opposite party No.2. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Patna, in connection with Complaint Case No. 1122(C) of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioners will co-operate in amicable settlement of their dispute.
