The petitioner apprehends his arrest in connection with Complaint Case No. 2918/2013, registered under Sections 406, 420, 504 and 34of the Indian Penal Code.

The accusation is that petitioner agreed to execute the sale deed of 22 kattha land on payment of Rs. 43,34,000/- to the complainant/opposite party no. 2. Except Rs. 10,000/-, entire consideration amount was paid to the petitioner, but he did not execute the sale deed.

Learned counsel for the petitioner submits that from perusal of the F.I.R. itself, it appears that the complainant/opposite

Patna High Court Cr.Misc. No.26489 of 2017 (3) dt.11-09-2017 2/2 party no. 2 has given Rs. 43,24,000/- to the mother of the petitioner, but not a chit of paper has been produced regarding payment of the same. The present case has been filed to give undue pressure upon the petitioner.

Having considered the facts and the circumstances of the case and nature of allegation, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Purnea in connection with Complaint Case No. 2918/2013, subject to the conditions laid down under Section 438(2) Cr.P.C.
