ANJANA MISHRA ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel for the informant.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341/ 323/324/379/504 and 506 of the Indian Penal Code. Learned counsel for the petitioner submits that the present case has been lodged out of pure vendetta as it is alleged that informant had been lending her mobile phone to the daughter of the petitioner to talk to several persons which was being objected to by the petitioner. He further submits that the theory of theft as made out by the informant is only to make the allegation grave and for putting the petitioner behind the bar.

No.29452 of 2015 (3) dt.06-10-2015 P2/2 Considering the fact that there is no further cogent material in the case diary and that the allegations as made by the informant are itself in the cloud, let the petitioner, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, Birpur, District-Supaul in connection with Karjain P.S. Case No.26/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
