The petitioner seeks bail in S.Tr. No.

406/2018/388/2018, Jamhore P.S. Case No. 51 of 2018, instituted for the offences under Section 304B/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is the husband of the deceased. He is in custody since 25.05.2018.There is general and omnibus allegation against this petitioner. The deceased died after consuming poison due to altercation between husband and wife.

In the written report it is alleged that daughter of the informant was married to petitioner in the year 2005. She was tortured for non-fulfillment of demand of dowry and on

Patna High Court CR. MISC. No.1649 of 2019(3) dt.28-03-2019 2/2 25.05.2018 informant got information that she has consumed poison.

Learned counsel for the petitioner has submitted that daughter of informant has been married in the year 2005. There is no any earlier complaint against petitioner of torturing his daughter.

The case diary has been received.

Learned APP has submitted that witnesses have stated in paragraph 31 and 32 of the case diary that daughter of informant died after consuming poison.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge II, Aurangabad (Bihar), in connection with Session Tr. No. 406/2018/388/2018, in connection with Jamhore P.S. Case No. 51 of 2018.
