The petitioner apprehends his arrest in connection with Complaint Case No. 1318 of 2018 for the offence registered under Sections 498(A) of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

On the last occasion, a co-ordinate Bench of this Court on 09.11.2022 had issued notice upon the opposite party no. 2 (complainant).

As per the office report, the lady received the notice on 06.12.2022.

Today, on call no one appeared on her behalf to contest this petition.

Considering the submissions made by the learned counsel for the petitioner that he has already filed a petition for restitution of conjugal rights before the appropriate Court as per paragraph-6 of the petition, he is ready to keep the complainant with full dignity and honour and ultimately will have to face the trial, this Court is inclined to grant him privilege of anticipatory bail.

Let the petitioner, in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Banka in connection with Complaint Case No. 1318 of 2018, subject to condition as laid down under Section 438(2) of the Cr.P.C.
