The present petition has been filed for modifying the order dated 01.07.2019 passed by a co-ordinate Bench of this Court in Cr. Misc. No. 7707 of 2019 to the extent that the period mentioned therein for enabling the petitioner to surrender before the learned court below, be extended by a further period of two weeks from today.

The learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.4820 of 2021(2) dt.19-01-2021 2/2 that on account of pandemic Covid-19 and attending difficulties as also on account of the father of the petitioners being seriously ill, the petitioners could not surrender within a period of three weeks, however, they undertake to surrender before the learned court below within a period of two weeks from today. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners and taking into account the prayer made in the present petition, I deem it fit and proper to extend the time granted to the petitioners to surrender before the learned court of Chief Judicial Magistrate, Bhagalpur in connection with Complaint Case No. 893 of 2018, by a further period of two weeks from today.

Rest of the conditions mentioned in the order dated 01.07.2019 shall remain the same.

Accordingly, the order dated 01.07.2019 passed in Cr. Misc. No. 7707 of 2019 stands modified to the extent indicated above.

The present petition stands disposed of.
