JUSTICE RAVI RANJAN ORAL ORDER 17-09-2016 As prayed, learned counsel for the petitioner is permitted to make necessary correction in paragraph no. 1 of the application for adding Section 307 Indian Penal Code in course of the day.

I have heard learned counsel for the petitioner, the State and the informant.

The petitioner apprehends his arrest in a case registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 504 of the Indian Penal Code and Section 27 of Arms Act. It is contended on behalf of the petitioner that dispute with respect to use of the drainage. There is case and counter case and injuries upon the informant are simple in nature.

No.34412 of 2016 (2) dt.17-09-2016 2/2 Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Noorsarai P.S. Case No. 95 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
