The petitioner seeks bail in connection with Rosera P.S. Case No. 103 of 2023 registered for the offence under Sections 30(a) of Bihar Prohibition & Excise Act 2022. Learned counsel for the petitioner submits that the petitioner is in custody since 07.02.2023, the petitioner has two antecedent and it is alleged that there is recovery of 24 liters of country made liquor.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the recovery of liquor, this application for regular bail is allowed. Let the petitioner, above named, be released on bail

Patna High Court CR. MISC. No.23957 of 2023(2) dt.15-05-2023 2/2 after completing six months in custody and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge-I, Samastipur in connection with Rosera P.S. Case No. 103/2023(Excise G.R. No. 101/2023).

The petitioner will visit Rosera Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
