JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 26-04-2019 Mr. Gyan Prakash, learned counsel for the petitioner, at the outset informed this Court that the facts of this case is squarely covered by a judgment reported in 2016(2) PLJR 421 (Triloki Nath & Ors versus The Chairman, Uttar Bihar Gramin Bank & Ors.)

2. If the facts of the case of the petitioner are covered by the aforesaid decision, needless to state, it will

3. This submission on behalf of the petitioner has not been refuted by Mr. Prabhakar Jha, learned counsel appearing for the respondent/Uttar Bihar Gramin Bank, but he submits that the petitioner, instead of approaching this Court in the first instance ought to have made a representation, taking reference of the aforesaid decision, before the Chairman, Uttar Bihar Gramin Bank and only if his grievances were not redressed on his representation, would he have been justified in approaching this Court thereafter.

Under the aforesaid circumstances, the petitioner is directed to make a representation before the Chairman, Uttar Bihar Gramin Bank (respondent No. 2) within a period of two weeks from today, who, on receipt of such representation shall verify the facts and on finding case of the petitioner to be exactly similar to the one decided in the case of Triloki Nath (supra), necessary sequel order shall be passed or caused to be passed within a period of four weeks thereafter.

5. With the aforesaid observation/direction, the writ petition stands disposed off.
