JUSTICE SANJAY PRIYA ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Ghoshi P.S. Case No. 30 of 2017 instituted for the offence under Section-307 & other minor sections of the Indian Penal Code and 27 of Arms Act.
There is specific allegation against this petitioner in the written report of causing fire-arm injury on the hand of the informant. As mentioned in the impugned order, the aforesaid allegation finds support from the injury report mentioned at paragraph-33 of the C.D. wherein the doctor has found 1-entry wound 2 cm x 2 cm over lateral aspect of right elbow joint region surrounded by blackening of skin and particles of cloth found near entry wound 2-Exit wound 4 cm x 2 cm over medial aspect of
Patna High Court Cr.Misc. No.26730 of 2017 (2) dt.06-07-2017 2/2 right elbow joint region and 3- Entry wound 2 cm x 2 cm antero lateral aspect of right side of upper abdomen. All the injuries were caused by fire-arms.
In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is rejected. The petitioner is directed to surrender in the court below and seek regular bail which shall be considered on its own merit without being prejudiced by this order. (Sanjay Priya, J) A.K.V./- U T
