JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Petitioners apprehend their arrest in connection with Goraul P.S. Case No. 158 of 2018 registered for the offences punishable under Sections 147, 148, 149, 447, 153, 188 and 153A of the Indian Penal Code.

Allegation against the petitioners is of installing of statue of Lord Hanuman on the Government land and it appears that they have been made accused in one more case. Submission of learned counsel for the petitioners is that no specific allegation has been attributed against any of them and for the same occurrence another case has been lodged

Patna High Court Cr.Misc. No.1027 of 2019(2) dt.16-01-2019 2/2 and except that they are not accused in any other case. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Goraul P.S. Case No. 158 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
