JUSTICE HARISH KUMAR ORAL ORDER 24-07-2026 Heard Mr. Anil Kumar Sinha, learned Advocate for the petitioner as well as learned Additional Public Prosecutor for the State. The informant is represented through Mr. Ajay Kumar Sinha, learned Advocate.
2. The petitioner apprehends his arrest in connection with Bodhgaya P.S. Case No. 50 of 2026, registered for the offenses punishable under Sections 406, 420, 467, 468/34 of the I.P.C.
3. Allegedly the accused persons in conspiracy with each other, on the pretext of providing employment, duped Rs. 5,15,000 amount from the informant. There is specific allegation that on the dictate of co-accused Umesh Rajak, this petitioner has also received Rs. 85,000 in order to extend

4. Learned Advocate for the petitioner taking this Court through the FIR contended that even if the allegation taken to be true, only Rs. 85,000 has been handed over to the petitioner, that too, on the dictate of the co-accused person. Since the informant had entered into an agreement, the consideration of which is wholly illegal and fraudulent, therefore, such act of the informant is itself a crime. However, the petitioner is still ready to return the amount to the informant and for the said purpose he has come up with a demand draft of Rs. 85,000 bearing no. 443674.
5. Learned Advocate for the informant submitted that on instruction, he is ready to receive the demand draft of Rs. 85,000, which shall be handed over to the informant.

Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the nature of the dispute, besides the fact that the petitioner has received Rs. 85,000 and now he is ready to return the money through the demand draft as noted herein-above, as also petitioner is carrying fair antecedent, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of

No.25521 of 2026(6) dt.24-07-2026 3/3 receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Addl. Sessions Judge-III, Gaya in connection with Bodhgaya P.S. Case No. 50 of 2026, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
7. It is further directed that the learned Advocate for the informant shall make an acknowledgment regarding receipt of the demand draft of Rs. 85,000 bearing no. 443674. (Harish Kumar, J) siddharth/- U T
