JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2019 This is an application for grant of anticipatory bail in connection with Mahua P.S. Case No. 390 of 2018, disclosing offences under Sections 414, 34 of the Indian Penal Code and Sections 30, 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. is that police on information raided a place and recovered 2950 liters liquor from a Pickup van and petitioner is also named in the F.I.R., though succeeded in fleeing away from the spot. Further it appears that the petitioner is accused in one more case of similar type. Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and moreover other case is concerned, he is on bail in that case.

Having heard both sides, considering the facts and circumstances of the case and criminal antecedent of the petitioner, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.

Accordingly, this application is dismissed.
