ANJANA MISHRA ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 498(A) and other Sections of the Indian Penal Code as well as Section 4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that after filing of the Complaint Case No. 937 of 2008 in which cognizance was taken in the year 2008 itself, the complainant left pairvi and did not pursue the matter. Knowledge of the present case came to the petitioner in the year 2015 as such he is apprehending his arrest. Learned counsel for the State after perusal of the Lower
Patna High Court Cr.Misc. No.29500 of 2015 (3) dt.06-10-2015 P2/2 Court Records which was called for earlier, submits that the submission of the petitioner is correct.
Considering the aforementioned facts and circumstances and that the complainant has virtually abandoned the case, let the petitioner abovenamed, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jehanabad in connection with Complaint Case No. 937/2008 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
