The matter is being heard through video conferencing due to circumstances prevailing on account of Covid-19 pandemic.

Heard learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest in connection with Srikrishnapuri P.S. Case No.333 of 2019 registered for offences under Sections 341, 323, 448, 307 and 379/34 of the Indian Penal Code.

It has been submitted by learned counsel for the

Patna High Court CR. MISC. No.31991 of 2021(3) dt.01-04-2022 2/2 petitioners that the petitioners and opposite party no.2 are closely related and they have entered into a compromise and they are staying in the same house.

Considering the aforesaid facts, this application for anticipatory bail is allowed.

Accordingly, let petitioners, above-named, in the event of their arrest or surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, xxx in connection with xxx Case No. 456 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. While accepting the bail bonds of the petitioner, the court below shall verify from the opposite party no. 2 as to whether both the parties have entered into a compromise and if it is found that they have entered into a compromise, bail bonds of the petitioners shall be accepted by the court below. If opposite party no. 2 denies the factum of compromise, the petitioners shall be taken into custody by the court below. (Sandeep Kumar, J) BT/- U T
