This is an application for grant of regular bail filed by the petitioner. Petitioner is in custody in connection with Paras Bigha PS Case No. 133 of 2018 for the alleged offence under Sections 363, 366, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. He further submits that petitioner and the alleged victim are close relatives, i.e. the girl is sister-in-law of the sister of the petitioner. Referring to the statement under Section 164, CrPC learned counsel submits that there is no allegation of foul play against the petitioner except that the victim accompanied him.
Considering the totality of the fact situation and that
Patna High Court Cr.Misc. No.80567 of 2018(22) dt.15-01-2019 2/2 the petitioner is in custody since 13.08.2018, this application is allowed. Accordingly, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Pranav Kumar, Judicial Magistrate 1st Class, Jehanabad in connection with Paras Bigha PS Case No. 133 of 2018 subject to the condition that bailors should be the family members.
