2. The petitioner apprehends arrest in connection with Supaul PS Case No.53 of 2017 dated 26.01.2017, instituted under Sections 147, 148, 149, 341, 323, 324, 307, 379, 354, 504, 506 of the Indian Penal Code.

3. The allegation against the petitioner is that he assaulted on the head of the petitioner by means of farsa with intention to kill him.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Further submission is that as per the injury report of the injured the injury was caused by hard and blunt substance and

Kasim @ Kasim has been granted anticipatory bail by this Court vide order dated 01.11.2023 passed in Cr. Misc. No.70520 of 2023. Lastly, it is submitted that the petitioner has no criminal antecdents.

5. Learned APP has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul, in Supaul PS Case No.53 of 2017.

7. The application stands allowed.
