Mr.Jagdhar Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 09-08-2024 Heard Mr. Sunil Kumar, learned counsel appearing on behalf of the petitioner and Mr. Jagdhar Prasad, learned APP for the State.

2. The present application has been filed for modification of the order dated 18.01.2024 passed in Cr. Misc. No.83796 of 2023, whereby petitioner was allowed anticipatory bail and the learned District Court was directed to verify the criminal antecedent of the petitioner.

3. Learned counsel appearing on behalf of the petitioner submitted that petitioner could not surrender within time in view of the fact that the report relating to criminal antecedent of the petitioner was not produced before the learned District Court and, as such, the petitioner bail bond

Patna High Court CR. MISC. No.32758 of 2024(2) dt.09-08-2024 2/2 could not be accepted and, thus, petitioner seeks extension of time for surrender.

4. Considering the aforesaid information given on behalf of the petitioner, the period of surrender is extended and the petitioner is directed to surrender before the learned District Court on 20.08.2024 and the learned District court is directed to accept the bail bond of the petitioner on the similar terms and conditions which was imposed vide order dated 18.01.2024 passed in Cr. Misc. No.83796 of 2023, and by which date, report relating to the criminal antecedent of the petitioner must be made available before the learned District Court. In case the same is not made available then also petitioner shall be released of pre-arrest bail.

5. The order dated 18.01.2024 passed in Cr. Misc. No.83796 of 2023 is modified to the aforesaid extent only. Rest parts of the order shall remain intact.

6. The modification petition is, accordingly, disposed of.
