JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case is that the villagers made complaint regarding irregularity in the mid-day-meal being given to the children in the school and when the officials of the block came to make enquiry then seven accused persons including petitioner assaulted them. It is alleged that petitioner was armed with Khanti when co-accused Tuntun Singh assaulted on the left hand of the informant and Satyendra Singh assaulted with riffle when other accused persons assaulted with lathi and Khanti.
It is submitted by learned counsel for the petitioner that accusation is omnibus and general against the
Patna High Court Cr.Misc. No.49735 of 2015 (2) dt.06-11-2015 2/2 petitioner. The injury report reflects only one injury. The informant's side was inimical with the petitioner's side since at earlier point of time one person was killed at the hands of the informant's side.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Wazirganj P.S. Case No. 192 of 2008, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
