JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 342, 447, 354 of the Indian Penal Code.

It is alleged that petitioner used to tease the informant and on 28.07.2015 when the informant went to ease then this petitioner lifted the informant and jumped from the boundary and tried to outrage the modesty of the informant. It is submitted by learned counsel for the petitioner that for the occurrence of 28.07.2015 the First Information Report was registered on 29.07.2015. There is no other eye witness to the occurrence except the informant. No injury was caused to the informant. The mother of petitioner was assaulted by the informant's side after addressing her as witch for which she filed Complaint Case No. 1351 of 2015. A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.391 of 2016 (2) dt.07-01-2016 2/2 petition that petitioner has no criminal antecedent. Considering the nature of accusation which is not being supported by the medical opinion and there being counter version though subsequent to the present case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 278 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
