JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-07-2020 Heard Mr. Priyesh Kumar, learned counsel for the petitioner and Mr. Ajit Kumar, learned APP for the State. The petitioner, who is in custody since 01.03.2020, seeks bail in connection with Tisiauta P.S. Case No. 95 of 2019, dated 14.11.2019, instituted for the offences under Section 30(a), (b) and (c) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

It appears from the F.I.R. that from a house which is in joint possession of the petitioner and others, 713.83 litres of liquor was recovered.

Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.21778 of 2020(2) dt.08-07-2020 2/2 that he has not been arrested from the spot. It has further been submitted that the petitioner has been made accused in this case only because he is one of the joint owners of the place from where the recovery has been made.

Regard being had to the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-CumExcise Court, Vaishali at Hajipur in connection with Tisiauta P.S. Case No. 95 of 2019.

The application stands allowed.
