1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Magadh Medical P.S. Case no.258 of 2023 registered under sections 304B and 34 of the Indian Penal Code.

3. As per the prosecution case, the daughter of the informant was married to the son of the petitioner herein but she was mentally and physically tortured by the accused persons. The informant states that he received information about his daughter having been done to death. It is stated that he is convinced that the accused persons strangulated her.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case on

The postmortem report does not support the prosecution case wherein the cause of death is said to be by hanging. The petitioner, who is a lady, is in custody since 31.1.2024 and co-accused Gunjan Kumar has been enlarged on bail vide order dated 11.10.2023 passed in Cr. Misc. no.64190 of 2023. It is further submitted that one charge-sheet no.194 of 2023 dated 31.8.2023 has been submitted against co-accused Gunjan Kumar under sections 306/34 of the Indian Penal Code.

5. The application for bail is opposed by learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner being the mother-in-law of the deceased, her having remained in custody since 31.1.2024 and chargesheet having been submitted against one of the co-accused namely Gunjan Kumar under sections 306/34 of the Indian Penal Code in the instant case, the petitioner is directed to be enlarged on bail in connection with Magadh Medical P.S. Case no.258 of 2023 on furnishing bail bond of Rs.10,000/-

Patna High Court CR. MISC. No.26248 of 2024(2) dt.10-04-2024 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya.
