ANJANA MISHRA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 20.02.2019 in connection with S.T. Excise Case No.103 of 2019 arising out of Nirmali P.S. Case No.25 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner was taken into custody on mere suspicion and the alleged recoveries are absolutely concocted. In fact, nothing has been seized from the conscious possession of the petitioner. Learned counsel for the petitioner further submits that the petitioner has got no criminal antecedents.

Considering the aforementioned facts and
