ANJANA MISHRA ORAL ORDER 06-09-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Isuapur P.S. Case No.129 of 2015 for allegedly having committed the offences under Sections 420, 467 and 468/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that save and except the allegation that on certain date i.e., 5.12.2012, the complainant was introduced to the present petitioners at the house of Accused Nos. 4 and 5, there is no allegation against these petitioner. It is further submitted that the complainant has also not clearly stated as to who had given the amount of
Patna High Court Cr.Misc. No.27897 of 2016 (2) dt.06-09-2016 2/2 Rs.1,50,000/- for securing job and who was responsible for issuing fake appointment letter.
Considering the nature of allegations made and that the main allegation is against Accused Nos.4 and 5, who are not the petitioners, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Isuapur P.S. Case No.129 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
