JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-11-2024 The present petition has been filed for restoring a petition bearing MJC No. 747 of 2020, which has stood dismissed for default on account of non-compliance of the peremptory order dated 2.8.2023.

The learned counsel for the petitioner submits that the earlier counsel has been ill since quite some time, hence the defects pointed out by the registry could not be removed, nonetheless, the present counsel has taken a no objection certificate from him and filed the present petition for restoration, thus, a sympathetic view be taken and the aforesaid petition be restored to its original file, subject to the petitioner removing the defects within a period of four weeks from today. 3.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to restore the aforesaid petition bearing MJC No. 747 of 2020 to its original file, however, subject to the petitioner removing the defects, as pointed out by the registry, within a period of four weeks from today.

Accordingly, the present restoration petition stands disposed off on the aforesaid terms.
