JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 04-11-2015 Both the applications arise out of Kanti P.S. Case No. 41 of 2014 registered under sections 302 and 201/34 IPC. Heard counsel(s) appearing in support of the two bail applications and APP for the State.
The village Dafadar lodged the case against unknown alleging that a dead body of 25-year-old young person was found deserted in a ditch. Few days after the occurrence the father of the deceased filed an affidavit in which it was alleged that his son was seen in the company of the petitioner and two accused persons. He
Patna High Court Cr.Misc. No.49118 of 2015 (2) dt.04-11-2015 2/2 suspected the hands of the accused persons in whose company his deceased son was seen.
The contention of the petitioners is that two other accused persons with identical allegation have since been granted the privilege of anticipatory bail by this Court. Web copies of the orders dated 15.10.2015 and 30.10.2015 passed in Cr. Misc. Nos.47359 of 2015 and 48133 of 2015 have been produced which are taken on record and marked as 'X' & 'Y' for identification. It is stated that the petitioners have no criminal antecedents.
In the facts and circumstances of the case, petitioners above named in the event of arrest/surrender within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of CJM, Muzaffarpur in Kanti P.S. Case No. 41 of 2015 on condition that one of the bailors shall be their own/close family members. In the event of framing of charge, they shall appear in person on each date fixed at the trial. Failure in appearance on two consecutive dates, shall lead to cancellation of their bail bonds.
