The petitioner apprehends his arrest in Khajekalan P.S. Case No. 140 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that the petitioner and others assaulted him and caused injury with Hasua on his head. Learned counsel for the petitioner submits that the petitioner is nephew (Bhagina) of the informant. There is a land dispute between the parties, but from perusal of the injury report it appears that the petitioner caused lacerated wound with Hasua (sickle) on the head of the informant and opinion with regard to nature of injury is kept reserved.

Considering the facts aforesaid, I am not inclined to

Patna High Court Cr.Misc. No.34019 of 2016 (3) dt.26-09-2016 2/2 enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
