ANJANA MISHRA ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire case is based on the presumption that the motorcycle in question so recovered from the possession of the petitioner was a stolen motorcycle. However, there is nothing on record to indicate the same. He further submits that co-accused Gunjan Yadav has also been granted the privilege of anticipatory bail from the Court below.

Considering the aforementioned facts and circumstances and that the petitioner is also a co-accused in the same case, let the petitioner abovenamed, in the event of his arrest / surrender within

Patna High Court Cr.Misc. No.27021 of 2017 (2) dt.07-07-2017 P2/2 a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sadar, Sitamarhi, in connection with Bela P.S. Case No. 03/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
